Terms of Service

These Terms of Service (“Terms”) govern your use of the Chenashe Property Management System (“Service”) provided by Chenashe (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.

1. Account and access

You are responsible for maintaining the security of your account credentials. You must not share login details or bypass multi-factor authentication. The account administrator is responsible for managing user access within their organisation.

2. Your data

Your organisation retains ownership of all data entered into the Service. We do not claim any intellectual property rights over your data. We process your data solely to provide the Service and as described in our Privacy Policy.

You are responsible for ensuring that your use of the Service complies with applicable privacy laws, including obtaining any necessary consents from individuals whose data you enter into the system.

3. Free trial

New accounts receive a 30-day free trial with full access to all features. When the trial expires, your account becomes read-only. Your data is preserved and full access is restored when you subscribe to a paid plan. We do not delete trial data automatically.

4. Subscription and payment

Paid plans are billed monthly or annually in Australian Dollars. Payments are processed by Stripe. You may upgrade, downgrade, or cancel your subscription at any time from the Settings page. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Acceptable use

You agree to use the Service only for its intended purpose of property management. You must not attempt to access another organisation’s data, reverse engineer the Service, or use the Service to store or transmit malicious content.

6. AI-assisted features

The Service includes AI-assisted drafting features for inspection summaries, notices, and VCAT applications. All AI-generated content is clearly labelled as a suggestion and is not sent, submitted, or applied until a staff member reviews and approves it. AI features are only available for tenants who have consented to AI-assisted drafting via their privacy settings. You remain responsible for the accuracy and appropriateness of any content you approve and send.

7. Service availability

We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability, with advance notice where practicable. The Service includes offline capabilities for field work; data entered offline is synced when connectivity is restored.

8. Limitation of liability

To the maximum extent permitted by Australian law, our liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to account administrators at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Victoria.
